Terms of Service

1. Acceptance of terms
By accessing or using the Visit Gauteng Progressive Web App (“the App”), operated by the Gauteng Tourism Authority (GTA), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 18 years old to make bookings or marketplace purchases. Users under 18 may browse with parental consent but may not transact. Vendors must be duly registered legal entities or individuals operating a lawful business in the Republic of South Africa.
3. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. User-generated content
You retain ownership of content you post to the Live feed. By posting, you grant the GTA a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote your content within the App and related GTA marketing channels. Your content must not:
- Contain hate speech, harassment, threats, or discrimination based on any protected characteristic.
- Infringe any third-party copyright, trademark, or other intellectual property right.
- Contain sexually explicit material, gratuitous violence, or content illegal under South African law.
- Constitute spam, advertising, or unsolicited commercial messages.
We may remove any content that violates these Terms at our sole discretion, without prior notice.
5. Marketplace rules
5.1 Platform operator, not seller of record
The GTA operates the marketplace as a facilitator, not as the seller of record. When you purchase from a vendor, you enter into a direct contract with that vendor. The GTA is not a party to that contract and is not responsible for vendor products, delivery, or after-sale disputes, except as a facilitator under the Consumer Protection Act 68 of 2008 (CPA).
5.2 Vendor obligations
Vendors must be South African-registered businesses or sole proprietors. Vendors warrant that their products are legal, accurately described, fit for purpose, and compliant with all applicable South African regulations.
5.3 Returns and refunds
Buyers are entitled to the rights afforded under the CPA, including the right to return defective goods within six months of delivery. Unresolved return requests should be escalated to [email protected].
6. Bookings
A booking confirmation does not guarantee admission if the attraction operates at capacity or is cancelled due to circumstances beyond our or the attraction’s control. Cancellation policies are set by each attraction. No-show guests forfeit their booking at the attraction’s discretion.
7. Payments
All payments are processed by PayFast (Pty) Ltd. We do not store your card details. Vendor payouts are calculated after a platform service fee and disbursed via PayFast Vendor Split. Disputed charges must be raised with PayFast directly.
8. Prohibited conduct
- Violating any applicable South African or international law.
- Impersonating any person or entity.
- Introducing malware or code designed to disrupt the App.
- Scraping or using automated tools to extract data without written consent.
- Circumventing or disabling security features.
9. Intellectual property
The Visit Gauteng name, logos, design system, and all GTA-owned content are the intellectual property of the Gauteng Tourism Authority. Nothing in these Terms grants you any licence to use GTA intellectual property outside the App’s normal functionality.
10. Third-party links
The App may link to third-party websites. We do not endorse or control those sites. Accessing them is at your own risk.
11. Disclaimers and limitation of liability
The App is provided “as is” without warranties of any kind. To the maximum extent permitted by South African law (including the CPA where applicable), the GTA is not liable for indirect, incidental, or consequential loss arising from your use of the App, or for acts or omissions of vendors or attraction operators. Nothing limits liability for death or personal injury caused by our negligence.
12. Indemnity
You agree to indemnify and hold harmless the GTA, its employees, agents, and partners from any claims, losses, or expenses arising from your breach of these Terms or your use of the App in a manner that harms a third party.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the Gauteng High Court, Johannesburg, unless you elect small-claims court or the National Consumer Tribunal as permitted by the CPA.
14. Termination
We may suspend or terminate your access at any time for violation of these Terms, fraudulent activity, or any other reason at our discretion. You may terminate your account via Account Settings → Delete Account.
15. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via in-app banner or email. Continued use after the effective date constitutes acceptance.
